Maintenance Requirement

A Declaration of Actual Use should be filed within three (3) years from filing date of the application and within one (1) year from the fifth anniversary of the registration of the mark. Otherwise, the application shall be refused registration or the registration shall be cancelled.

Renewal Procedure

  1. A certificate of registration may be renewed for periods of ten (10) years each at any time within six (6) months before its expiration or within six (6) months after its expiration on payment of an additional fee.
  2. The request for renewal shall be filed with the Bureau of Trademarks of the Intellectual Property Philippines (IPO).
  3. The application for renewal may be refused by the examiner for any valid reason. The application for renewal may be then completed or amended to address the refusal, or the case may be appealed to the Director if the refusal has become final.
  4. The registrant may request for the issuance of a Certificate of Renewal of Registration. Upon payment of the required fee, the Certificate of Renewal of Registration shall be issued.
