Trademarks / Service Marks

A trademark or service mark is any visible sign capable of distinguishing the goods (trademark) or services (service mark) of an enterprise and shall include a stamped or marked container of goods.

Filing Requirements

The following documents are required to be submitted in filing a trademark application:

  1. Duly accomplished Trademark Application containing the following information:
    1. name and address of the applicant;
    2. nationality of the applicant
    3. list of goods or services for which the registration is sought, together with the Nice Classification class to which the goods or services belong;
    4. where there is a claim of a priority date of an earlier filed foreign application:
      1. the name of the country where the priority application was filed;
      2. the application number and filing date of the priority application; and
      3. a certified copy of the priority application
    5. where the applicant wishes to claim color as a distinctive feature of the mark, the colors claimed and an indication, in respect of each color, of the principal parts of the mark which are in that color;
    6. where the mark is a three-dimensional mark, a statement to that effect;
  2. A copy of the mark in .jpeg format, 2 x 3 inches in size; and
  3. Special Power of Attorney.
