A petition to cancel an invention patent may be filed by an interested person on any of the following grounds:
- That what is claimed as the invention is not new or patentable;
- That the patent does not disclose the invention in a manner sufficiently clear and complete for it to be carried out by any person skilled in the art, or
- That the patent is contrary to public order or morality.
A petition to cancel a utility model registration may be filed by any interested person on any of the following grounds:
- That the claimed invention does not qualify for registration as a utility model and does not meet the requirements of registrability;
- That the description and the claims do not comply with the prescribed requirements;
- That any drawing which is necessary for the understanding of the invention has not been furnished; and
- That the owner of the utility model registration is not the inventor or his successor in title.
A petition to cancel an industrial design registration may be filed by any interested person on any of the following grounds:
- The subject matter of the industrial design is not registrable;
- The subject matter is not new; or
- The subject matter of the industrial design extends beyond the content of the application as originally filed.
